Acceptance of the General Terms and Conditions of Contracting and Access to the Website
Accessing, browsing, and using the materials, content, or services available through the Website implies the understanding and express, unconditional acceptance of all the terms of these General Terms and Conditions of Contracting, which establish the rights and obligations of Las Palmeritas S.A.T. (hereinafter, Las Palmeritas) and the User for the purchase of the products offered on the Website, having the same validity and effectiveness as any contract executed in writing and signed.
Access to the Website does not require user registration. However, to purchase the products offered by Las Palmeritas, the User must submit the information requested in the Purchase Registration Form, including personal data, and accept these terms before starting the procedures to formalize the corresponding payment.
Purpose of the General Terms and Conditions of Contracting and Access to the Website
These General Terms and Conditions of Contracting govern access, browsing, and use of the Website, without prejudice to Las Palmeritas reserving the right to modify their presentation, configuration, and content, as well as the conditions required for access and/or use. Access to and use of the Website’s content after such modifications come into effect implies acceptance thereof.
Nevertheless, access to certain content and the use of certain services may be subject to specific conditions, which will in all cases be clearly displayed and must be expressly accepted by Users. These specific conditions may replace, supplement, or, where appropriate, modify these Terms of Use.
Las Palmeritas reserves the right to modify, in whole or in part, the terms and conditions set out herein, publishing any change in the same manner that these General Terms and Conditions of Contracting appear or through any type of communication addressed to Users.
Likewise, we inform Users about their rights and obligations in relation to the content displayed on the Website, the logos and trademarks used, as well as the responsibilities that may arise from the use of the service.
For the purposes of interpreting these Terms of Use, we understand that a person becomes a user at the moment they accept the General Terms and Conditions of Contracting and the Privacy Policy displayed on the Website, it being sufficient for this purpose that they visit it.
Purpose of the Website
Las Palmeritas is a company dedicated to the production and marketing of fruit and vegetable products. Las Palmeritas makes this Website available to the User as a channel to offer its products for sale directly to the end consumer.
How to Buy
Buying on laspalmeritassat.es is very simple: you just have to choose a product, add it to the basket by clicking on the cart icon, and place the order using one of the available payment methods.

The products offered through this service are intended for end consumers under the terms and conditions provided by Law 7/1996, of January 15, on the Regulation of Retail Trade, in its consolidated text dated October 17, 2014, by Law 34/2002 on Information Society Services and Electronic Commerce, by the General Data Protection Regulation 2016/679, by Organic Law 3/2018, of December 5, on the Protection of Personal Data and Guarantee of Digital Rights, and by Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws.
Civil and commercial legislation also applies to any issues not expressly covered in the aforementioned regulations.

CREDIT AND DEBIT CARDS
The Secure E-commerce system is based on the card issuer (bank or savings bank) identifying the cardholder before authorizing payment over the Internet.
This security system is implemented through the Virtual POS (Point-of-Sale Terminal) provided by the banking entity Redsys.
The entire process is carried out under appropriate security measures, using the HTTPS-SSL security protocol, which ensures data encryption at all times to prevent unauthorized access and maintain the security of the transaction.
Your card details and password are protected by this security system from the moment the page and/or form for entering them is displayed.
Once identification is completed, the Issuer of the Virtual POS informs Las Palmeritas that the purchase is being made by the cardholder and has been accepted, so that the process can be completed. If identification is not successful, the Issuer will notify Las Palmeritas to proceed accordingly.
This window is outside the control of Las Palmeritas; any incident that may arise with it is the responsibility of your Issuer, and you should contact that entity if faced with such a situation.

Delivery time
The order will be shipped to the specified address.
Orders will not be delivered to P.O. Boxes.
The general delivery time is a maximum of 10 business days, excluding Saturdays, Sundays, and holidays. Las Palmeritas will not be responsible for delays caused by circumstances beyond its control or by force majeure, such as procedures and clearances at postal offices or courier/parcel companies.
Shipping costs include transport and insurance. Handling and/or customs charges at destination and other taxes (duties or others) that may apply are not included; the recipient must pay them at destination to receive the goods. In exceptional situations, such as pandemics, strikes, natural disasters, or other normally unforeseeable events, the indicated delivery times cannot be guaranteed.
In the case of pickup directly at our Las Palmeritas premises, we will send you an email notice when the order is ready. To collect it, you must present the email and it will be delivered upon presentation of your ID.
If another person appears on your behalf, they must present their ID in addition to a copy of the confirmation email and a copy of the purchaser’s ID.
Shipping costs and delivery times to the Canary Islands, Ceuta, and Melilla

Warranty and Claims Resolution
Warranty
Royal Legislative Decree 1/2007 grants durable goods a legal warranty of 2 years from the date of purchase and/or delivery.
Therefore, Las Palmeritas guarantees the integrity of such goods for two years from the date of receipt of the product.
Defects caused by negligence, impacts, improper use or handling, or wear or degradation due to exposure to natural elements such as light, sun, dust, humidity, water, mold, harmful substances and/or atmospheres, or any other agent or context that may be detrimental to the product materials are not covered.
For warranty purposes, it is the buyer’s responsibility to ensure correct placement, exposure, handling, storage, transport, or any other handling of the products after receipt of the purchase.
In incidents that justify the use of the warranty, repair, replacement, price reduction, or refund will be chosen under the legally established terms.
For perishable products, if the product arrives in poor condition, the customer will have 48 hours to request a return of the products without any penalty, attaching a photograph of their condition. This right of return is limited to a maximum of 48 hours from delivery or pickup of the purchase.

Dispute Resolution:
- Las Palmeritas resolves disputes through direct negotiation with each buyer and provides the email address insert email address, assuring that it will make every effort to resolve the situation to the customer’s full satisfaction.
- Likewise, the customer has the right and may at any time, if desired, turn to the mechanisms provided by local and regional Public Administrations for the protection of consumers and users.
Nevertheless, we recommend contacting Las Palmeritas first to reach an agreement, trusting that it will be beneficial for both parties.
Right of Withdrawal and Order Returns
In accordance with current regulations, the customer has a period of 14 days to withdraw from the purchase without the need for justification, a period that begins from delivery of the order. After this period, the purchase becomes final and only the specified warranty conditions will apply.
In the event of withdrawal, the buyer shall bear the transport costs (postal, courier, parcel service, or other means) of the product to be returned.
The product must be unused and in perfect condition, complete including accessories and documentation, and in the original packaging.
The product to be returned must be delivered to Las Palmeritas within less than one month—except in cases of force majeure—from the date on which the right of withdrawal is exercised; therefore, the buyer must exercise due diligence in expediting shipment of the product to Las Palmeritas.
Once the goods have been received at our warehouses, and after verifying their condition, the refund of the amount will be processed under the terms established in Royal Legislative Decree 1/2007, according to the payment method used by the customer.
Return costs will be the responsibility of the customer, as will customs charges and local taxes and fees applied upon receipt of the product at Las Palmeritas’ address; such costs will be deducted from the refund amount.
If the return is due to a product in poor condition, upon prior authorization from Las Palmeritas, a pickup will be arranged at your address at no cost to the customer.
Returns are not accepted more than 48 hours after receipt of your order.

In this way, we will issue the pickup order for your shipment and we will be able to carry out a thorough return control.
Your money will be refunded within a maximum period of thirty days, although most refunds are made within ten days. Please include each and every item and packaging that was supplied to you.
In any case, the parties refer to the provisions of Articles 103.c and 103.d of Law 3/2014, of March 27, which amends the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, of November 16.
Exceptions to the Right of Withdrawal:
According to Article 103 of Royal Legislative Decree 1/2007, of November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users:
The right of withdrawal shall not apply to contracts that relate to:
- The supply of goods made to the consumer’s and user’s specifications or clearly personalized.
- The supply of goods that are liable to deteriorate or expire rapidly.
Therefore, excluded from the right of withdrawal are contracts for the supply of products made to the consumer’s and user’s specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly.
Customer Data: Registration, Modification, Security, and Confidentiality
To make purchases in our stores or access certain services, you must enter the e-commerce website using the username/password previously provided by Las Palmeritas, which will allow you to access the purchase pages where you can review the products available to be selected.

When you register on our secure server or place an order, your personal and address data, and your payment method details are incorporated into our database, used solely for the Customer Management processing and to manage the sale and shipment of the order placed by the customer, as well as to send information about offers and services directly related to the purchase made. Taxes
The prices of the products for sale will specify the applicable taxes in each case, IGIC, VAT, or any other applicable tax or fee, whether for residents in the Canary Islands, Ceuta, and Melilla, or for residents in mainland Spain or the Balearic Islands.
Please note that the shipping cost prices do not include taxes (duties) and/or import fees that may apply, which will be paid at destination by the recipient of the goods.
The e-commerce system is subject to the tax legislation in force in Spain.
